Annual Meeting June 16th: Vote on Rules and Bylaws

Board will consider comments on rules before issuing final revised rules.

Expect to receive new copies of complete bylaws and rules in a couple of months.

After several months work on the part of the Rules Committee, the Meadow Hill, Inc. Board of Directors proposed revised rules and proposed revised bylaws for Meadow Hill. At the annual meeting in June, unit owners will vote their advice on the revised rules and vote to adopt the revised bylaws. We are now in the Notice and Comment period. The Board recommends voting for the both.

The rules are subject to a Notification and Comment period and the bylaws are subject to notification, comment, and approval by the owners.  According to the Meadow Hill, Declaration:

Section 20.2 – Adoption of Rules. The Executive Board may adopt Rules regarding the use and occupancy of Units, Common Elements, and Limited Common Elements and the activities of occupants, subject to Notice and Comment.

ARTICLE XV, Amendments to Bylaws
The Bylaws may be amended by vote of two-thirds (2/3) of the members of the Executive Board and ten (10%) percent of the Unit Owners, following Notice and Comment to all Unit Owners, at any meeting duly called for such purpose

Section 23.1 – Right to Notice and Comment. Before the Executive Board amends the Bylaws or the Rules, whenever the Documents require that an action be taken after “Notice and Comment”, and at any other time the Executive Board determines, the Unit Owners have the right to receive notice of the proposed action and the right to comment orally or in writing. Notice of the proposed action shall be given to each Unit Owner in writing and shall be delivered personally or by mail to all Unit Owners at such address as appears in the records of the Association, or published in a newsletter or similar publication which is routinely circulated to all Unit Owners. The notice shall be given not less than five (5) days before the proposed action is to be taken. The right to Notice and Comment does not entitle a Unit Owner to be heard at a formally constituted meeting.

Many of the changes are to make the rules and bylaws consistent with existing practices of Meadow Hill, Inc.  For instance, we do not have (or intend to have) a committee pre-approve each proposed pet.  It has also not been our practice to vote by placing ballots in separate envelopes.

Other updates reflect changes we feel are appropriate to the community.  For instances, rules  associated with the new vinyl siding; taking into account inflation when it comes to fines and fees; allowing dogs to use the tennis courts in winter.

In other cases, we have clarified the existing rules and bylaws.  We have made an attempt to base our changes on all the past amendments that have been located.  We will be voting on the entire bylaws and rules, thus voiding any past amendments which may not have been located.
